Administrative Measures for the Installation of Mechanical Multi‑Storey Parking Facilities in Guangzhou City

 

Article 1: In order to standardize the installation and construction of mechanical automated parking facilities, this Measures is formulated in accordance with the Special Equipment Safety Law of the People’s Republic of China, the Guangzhou Parking Lot Regulations, and other relevant provisions, taking into account the actual conditions of this municipality.

 

Article 2 This Measures shall apply to the installation and construction of mechanical automated parking facilities within the administrative area of this municipality.

 

For the purposes of these Measures, “mechanical automated parking facilities” refer to mechanical equipment, systems, and related ancillary facilities that store and retrieve vehicles in a three-dimensional configuration.

 

Article 3: Units and individuals are encouraged to utilize their own construction land, idle land, land awaiting development, and scattered sites, among other available land uses, to install and construct mechanical automated parking facilities through leasing, cooperative operation, or other means, thereby alleviating the regional parking shortage.

 

Encourage social capital to invest in the construction of mechanical automated parking facilities.

 

Article 4: The departments of the Municipal People’s Government and the people’s governments of all districts shall, in accordance with the following division of responsibilities, ensure the proper installation and construction of mechanical automated parking facilities:

 

The development and reform authorities are responsible for the project approval process for mechanical multi‑storey parking facilities and for including such projects under public‑private partnership arrangements in the government‑social capital project database.

 

The competent department for planning and natural resources is responsible for the land-use planning approval of parking lots (garages), except in cases where permission is exempted by law.

 

The housing and urban–rural development authorities are responsible for issuing construction permits and filing completion acceptance records for mechanical automated parking facilities associated with new and renovated building projects, as well as for conducting fire safety design reviews and fire safety acceptance inspections for construction projects.

 

The competent transportation authority is responsible for issuing construction permits and filing completion acceptance records for projects involving the provision of mechanical multi‑storey parking facilities as ancillary works on newly constructed or reconstructed roads, as well as in urban rail transit construction projects.

 

The market supervision and administration authorities are responsible for handling pre-construction notification and usage registration procedures for mechanical automated parking facilities.

 

The people’s governments of each district are responsible for formulating implementation plans for mechanical automated parking facilities within their jurisdictions and for organizing their execution. Subdistrict offices and town people’s governments shall strengthen guidance and coordination for the installation of mechanical automated parking facilities in residential communities under their jurisdiction.

 

Article 5: For mechanical automated parking facility projects, the land use right holder or a market entity entrusted by it shall serve as the project applicant.

 

For government-invested mechanical automated parking facilities projects, the competent administrative department shall designate the project applicant in accordance with relevant regulations.

 

Article 6: Where the parking facilities provided within a residential community fail to meet the parking needs of its owners, and with the consent of owners whose exclusive-use units account for more than half of the building’s total area and who represent more than half of the total number of owners, mechanical, multi‑storey parking facilities may be installed or constructed on common areas within the development as temporary parking spaces. If a homeowners’ committee has already been elected in the residential community, it may act as the applicant, or it may delegate this responsibility to the property service enterprise; if no homeowners’ committee has been established, the property service enterprise may serve as the applicant.

 

Where mechanical, multi‑storey parking facilities are installed or constructed on village collective land, the requisite democratic procedures must be followed in accordance with the law, and the applicant shall be the village committee, the rural collective economic organization, or a market entity entrusted by them.

 

Article 7: The land-use planning approval procedures for mechanical automated parking facility projects shall be handled in accordance with the relevant provisions of Articles 16, 23, and 24 of the Guangzhou Parking Lot Regulations.

 

For mechanical multi‑storey parking facilities that, pursuant to Article 24 of the Guangzhou Parking Lot Regulations, are exempt from obtaining a construction project planning permit, no procedures for project approval or construction permitting are required. However, such facilities must, in accordance with applicable regulations, apply to the market supervision and administration authorities for pre‑construction notification and registration of use.

 

Mechanical automated parking facilities that require a construction project planning permit shall be subject to construction project management and must comply with the relevant approval procedures for engineering construction projects in this municipality. The competent administrative approval authorities shall, taking into account the specific characteristics and needs of such projects, clearly define the list of required documents and the detailed content for each administrative approval matter under their jurisdiction.

 

Article 8: Mechanical automated parking facilities located in parking lots with a total of fewer than 500 parking spaces, and which do not involve environmentally sensitive areas or civil engineering works, shall be exempt from the environmental impact assessment procedures.

 

Article 9: The installation of mechanical automated parking facilities shall comply with the relevant requirements of the Code for Fire Protection Design of Garages, Repair Shops, and Parking Lots (GB 50067–2014). Open-air, open‑type mechanical automated parking facilities shall be designed in accordance with parking‑lot fire‑protection standards, while indoor or outdoor, non‑open‑type facilities shall be designed according to garage fire‑protection standards. Furthermore, fire‑access routes must remain unobstructed, and the elevated‑operation area for fire trucks must be kept in normal working condition.

 

Encourage eligible mechanical automated parking facilities to provide parking spaces suitable for vehicles with larger exterior dimensions.

 

Article 10: Subject to lawful approval, ensuring safety, and without compromising the urban landscape, the management entity of mechanical automated parking facilities may utilize the external structure for advertising activities.

 

Article 11: For mechanical automated parking facilities installed to meet the parking provision requirements of construction projects, once they have been verified by the planning authorities and put into service, the constructing or managing entity shall ensure their normal operation and may not dismantle them without authorization. If, following such dismantling, the project fails to comply with the prescribed parking provision standards, the urban management comprehensive law enforcement authority shall impose penalties in accordance with Article 60 of the Guangzhou Parking Lot Regulations.

 

Article 12: The installation, modification, repair, operation, use, inspection, and testing of mechanical automated parking facilities shall comply with the safety requirements for special‑purpose facilities. The market supervision and administration authorities shall conduct safety supervision and inspection of such facilities in accordance with the Special Equipment Law of the People’s Republic of China and relevant technical specifications.

 

Mechanical automated parking facilities subject to construction project management shall comply with relevant regulations on construction quality management. The project owner, surveyor, designer, contractor, and other participating parties shall each bear primary responsibility for the quality and safety of the project. The housing and urban–rural development authorities and the transportation authorities shall, in accordance with their respective duties, exercise oversight over the quality and safety of the project.

 

Article 13: Upon completion of a commercial mechanical automated parking facility project, the operator shall, in accordance with law, complete the relevant procedures with the administrative departments for industry and commerce, taxation, and pricing, and file a record with the transportation authority of the district where the project is located.

 

Encourage operators of mechanical automated parking facilities to obtain public liability insurance.

 

Article 14: When installing mechanical automated parking facilities, appropriate site selection shall be ensured, and effective measures for sound insulation and vibration reduction shall be implemented to prevent adverse impacts on the ventilation, natural lighting, and solar exposure of adjacent buildings. Furthermore, such installations shall be harmonized with the surrounding architectural environment and comply with urban landscape requirements.

 

Article 15 This Measures shall come into force on October 1, 2019, and shall be valid for a period of five years.

 

Mechanical automated parking facilities that were completed prior to the implementation of these Measures may, in accordance with the relevant provisions herein, retroactively obtain the necessary formalities.
