Hunan – Changsha – “Notice on Standardizing the Management of Motor Vehicle Parking Lots”

 

To standardize the management of motor vehicle parking facilities, meet the demand for parking, and ensure that urban road traffic remains orderly, safe, and unimpeded, in accordance with the provisions of the Road Traffic Safety Law of the People’s Republic of China, the Hunan Province Parking Facility Management Measures, and the Changsha City Motor Vehicle Parking Facility Management Measures, the entities responsible for constructing public parking facilities or their operators shall comply with the following regulations:

 

1. According to Article 33 of the Road Safety Traffic Law of the People’s Republic of China, “Parking facilities that have been put into use may not be used for parking without authorization or repurposed for other uses.”

 

2. In accordance with Article 18 of the Measures for the Administration of Parking Lots of Hunan Province, “Public parking lots shall be connected to the urban public parking information system and transmit parking information in real time, among other requirements.”

 

3. In accordance with Article 13 of the “Administrative Measures for Parking Lots of Hunan Province,” motor vehicle parking lots shall display uniform parking‑lot signage at their entrances and exits; parking‑lot staff shall wear standardized identification badges; vehicle entry and exit information shall be properly maintained, with a retention period of no less than six months; and no other activities that impede vehicle access or parking shall be conducted within the parking lot.

 

4. In accordance with Article 13 of the Measures for the Administration of Motor Vehicle Parking Lots in Changsha, “The construction entity or the operator of a public parking lot shall, within 15 days after the completion and acceptance of the public parking lot, file a record with the traffic management department of the public security organ.”

 

Applications for the filing of public parking lots shall submit the following materials:

 

(1) Filing Application Form;
(2) Documentation proving ownership of land and housing use rights, as well as certificates confirming that the public parking facility has been completed and passed inspection;
(3) Photocopies of the site plan for the land or indoor venue, as well as the planning blue-line map;
(4) Parking space layout plan and schematic diagram showing the site’s street location;
(5) Proof of identity of the parking lot operator or manager;
(6) Management systems related to parking lots.

 

For publicly operated parking facilities that charge fees, the applicable parking fee schedule must also be submitted.

 

5. In accordance with Article 14 of the Measures for the Administration of Motor Vehicle Parking Lots in Changsha, “If any changes occur to the registration information regarding the configuration of parking spaces in public parking lots, the operator shall submit a report to the traffic management department of the public security organ at least ten days in advance.”

 

If a public parking facility is required to suspend operations, close temporarily, or cease use, it shall submit a report to the traffic management department of the public security organ at least 30 days in advance and publicly announce such decision.

 

6. In accordance with Article 15 of the Measures for the Administration of Motor Vehicle Parking Lots in Changsha, “Public parking lots located in areas where the public parking information system’s network connectivity has been activated shall, in compliance with relevant regulations and standards, establish a real-time parking information data transmission system compatible with the city’s public parking information system, integrate their parking information into the citywide public parking information system, and make such information available to the public in real time.”

 

Any violation of the foregoing provisions shall be subject to penalties in accordance with the law by the traffic management department of the public security organ.
