In May–June 2019, a series of parking policies came into effect. The Market Research Center for Parking (MRCPO) has compiled the following summary:
New Regulation No. 1: “Implementation Plan for Deepening the Reform of the Toll Road System and Abolishing Provincial Boundary Toll Stations on Expressways” (General Office of the State Council Document No. 23 [2019]), issued on May 16, 2019.
The plan explicitly states that by the end of 2019, the proportion of vehicles using ETC at highway entrances in each province will reach over 90%. Furthermore, starting July 1, 2020, newly approved vehicle models must include an ETC onboard unit as an optional configuration. The plan also mandates that, under the leadership of the Ministry of Transport, the free installation of ETC onboard units on existing vehicles be accelerated, ensuring that by the end of 2019, the ETC usage rate at provincial (regional and municipal) highway entrances exceeds 90%, while simultaneously achieving full coverage of mobile‑payment options at manual toll lanes. By the end of 2019, technical standards for ETC onboard units shall be finalized; beginning July 1, 2020, newly approved vehicle models must offer an ETC onboard unit as an optional feature. Funding for the installation of ETC onboard units, as well as for the construction and upgrading of related systems and infrastructure, will be centrally managed by the respective provincial people’s governments, with expenditures drawn from toll revenues and supplemented by fiscal subsidies, while local authorities are encouraged to mobilize funds through market‑based mechanisms.
New Regulation No. 2: Announcement of the State Administration for Market Regulation on Matters Relating to Administrative Licensing for Special Equipment (No. 3, 2019), effective June 1, 2019.
The announcement has revised the “Catalogue of Licensing for Special Equipment Manufacturing Units.” Under the new licensing framework, the licensing for the manufacture of mechanical parking equipment will be transferred from the former State Administration to provincial market supervision authorities authorized by the Administration.
New Regulation No. 3: Opinions of the General Office of the State Administration for Market Regulation on Matters Relating to Administrative Licensing for Special Equipment (SMR Special Equipment [2019] No. 32), issued on May 27, 2019.
The guidelines clarify that special‑equipment manufacturing and filling‑unit licenses issued on or before May 31, 2019 (inclusive; the same applies hereinafter) shall remain valid within their original scope and validity period. Prior to the expiration of such licenses, renewal shall be carried out in accordance with the new licensing requirements. For licensing matters that had already completed on-site assessment and review by May 31, 2019, licensing shall, after June 1, proceed in compliance with the new requirements. For licensing projects involving a change of the issuing authority, the original accepting authority shall notify the subsequent implementing authority in writing of the review report and the recommended licensing decision, and shall also inform the applicant to submit a supplementary application to the new implementing authority in accordance with the updated licensing requirements. For licensing projects that have been accepted but for which on-site assessment and review have not yet commenced, and which, pursuant to applicable regulations, will continue to be administered by the original implementing authority after June 1, 2019, such projects shall undergo review and issuance in line with the new licensing requirements, with issuance conditions as specified above. For licensing matters for which applications were submitted prior to May 31, 2019 but have not yet been accepted, applicants shall resubmit their applications after June 1, 2019, in accordance with the new licensing requirements. Effective June 1, all procedures related to license applications, acceptance, and the issuance of license certificates shall be conducted in compliance with the new licensing requirements. For products falling under the same category and subject to the same licensing project, where additional items are sought during the original license’s validity period— including applications filed after June 1, 2019, or those whose on-site assessment and review remained incomplete as of that date—such requests shall be processed in accordance with the new licensing requirements, and the original license shall be renewed concurrently. Where the relevant licensing falls under the jurisdiction of the General Administration, applicants meeting the criteria set forth above shall submit their applications directly to the General Administration. For licensing projects originally administered by the General Administration but, under the new licensing regime, to be implemented by provincial market‑regulation authorities, applicants shall file both the request for additional items and the application for license renewal with the provincial market‑regulation authority; upon receipt of the new certificate, they shall then apply to the General Administration to cancel the original certificate still in effect.
New Regulation No. 4: “Rules on Licensing of Special Equipment Manufacturing and Filling Units” (TSG 07—2019), promulgated and implemented on May 13, 2019.
The new regulations stipulate that mechanical parking equipment manufacturers must be equipped with the following production machinery and process equipment: (1) cutting machines; (2) drilling equipment; (3) bending machines; (4) shearing machines; (5) band saws; (6) at least five gas-shielded welding machines; (7) lifting equipment in the structural workshop, with a rated lifting capacity of no less than 5 tonnes; (8) steel pretreatment and derusting systems, or post‑treatment equipment for steel structure surfaces (outsourced processes are exempt); and (9) tooling, including jigs and fixtures for welding longitudinal beams, transverse beams, and columns. The floor area of the workshop dedicated to manufacturing load‑bearing structural components shall be no less than 3,000 square meters; the office space shall be no less than 300 square meters; and the warehouse shall be no less than 200 square meters. With respect to personnel, the regulations require that the technical staff responsible for manufacturing mechanical parking equipment comprise at least 12 individuals holding assistant engineer titles or higher in mechanical and electrical disciplines, including no fewer than six engineers who possess relevant technical work experience related to the licensed scope of activities. There must be no fewer than four full-time quality inspection personnel. Installation personnel shall number at least five, with at least one supervisor, one operator, no fewer than ten welders, and no fewer than three electricians. The project manager responsible for manufacturing must hold an engineering title, have a degree in mechanical or electrical engineering, and possess experience in the installation of lifting machinery.
New Regulation No. 5: Measures for the Administration of the Rental and Sale of Parking Spaces and Garages in Real Estate Development Projects in Guangzhou (Guangzhou Construction Regulation No. 5 [2019]), effective May 22, 2019.
The Measures stipulate that, prior to selling parking spaces or garages within a development’s designated area that are planned for vehicle parking, the real estate developer must obtain confirmation of ownership through initial registration. Furthermore, before renting out such parking spaces or garages, the developer must complete the required planning acceptance in accordance with the law and may not refuse to provide parking services under the pretext of “sales only, no rentals.”
New Regulation No. 6: “Administrative Measures for Parking Lots of Zhaoqing City” (2019), effective June 1, 2019.
The Measures stipulate that the municipal urban management and comprehensive law enforcement department serves as the competent authority for parking facilities, responsible for organizing the formulation and implementation of specialized parking‑facility planning, overseeing and managing parking operations, establishing a citywide unified parking information management system, promoting the intelligent and digital transformation of parking management, and providing guidance to relevant industry associations in their work.
New Regulation No. 7: Administrative Measures for Air-Raid Shelters Used for Residential Parking in Beijing (Beijing Civil Defense Document No. 57 of 2019), effective June 1, 2019.
The Measures stipulate that any entity operating or utilizing parking facilities within an air-raid shelter shall obtain a permit for the use of civil defense engineering. The permit is valid for one year and may be renewed upon expiration. Furthermore, the usage contract (agreement) entered into between the operating or using entity and the parking space user shall have a term consistent with that of the contract signed with the civil defense administrative authority.
